You need an attorney who is just as passionate about defending people as the prosecutor is about putting people in jail. Choose an attorney that will aggressively go after the prosecutor’s case, picking it apart, piece by piece. Criminal defense lawyers must understand the importance of "beyond a reasonable doubt," and he or she must possess the tools essential to providing a strong defense. These tools include motions to suppress, motions to dismiss, depositions and a firm understanding of the First, Fourth, Fifth, Sixth and Eighth Amendments to the United States Constitution. Most importantly when all other avenues fail you need a trial attorney who can tell your story effectively in front of a jury.
Over the last ten years there has been a steady erosion of civil liberties all across America. This erosion has allowed the Government to promulgate more laws and increase sentencing substantially. The result is the largest prison population in the world, topping over two million in 2003. This has resulted in a tremendous economic cost on the American people and more importantly this far reaching policy is affecting law abiding citizens that have never committed a crime or come into contact with the "criminal system". Wonderful people that have never had a reason to question this oppression are suddenly thrown into a terrifying situation, where they feel the true helplessness of having their lives in the hands of a single prosecutor, judge or police officer.
Fortunately there is still hope, men and woman who have dedicated their lives to protecting freedom, civil liberties, and fundamental rights. These fundamental rights include the presumption of innocence, right to remain silent, right to legal counsel, and the right to a trial by jury.
